Terms and Conditions of Trade

The following Terms and Conditions of Trade apply to all products and services provided by Tisco Waikato Computer Division Limited (“Tisco”). 

General
1          Terms and conditions of payment for the goods and/or services are cash on invoice unless otherwise agreed and specified on invoice. Interest will be charged on overdue accounts at the rate of 2% per month or part thereof. Any costs incurred by Tisco in collecting overdue accounts (including legal costs on a solicitor client basis) will be added to the account. 
2          All goods remain the property of Tisco until paid for in full. The customer agrees that if payment becomes overdue, Tisco or its agent may enter the customer’s premises to remove any goods which are the property of Tisco.
3          Due to fluctuation of New Zealand dollar, Tisco reserves the right to change price without notice at any time
4          All orders are subject to acceptance and confirmation by Tisco.
5          All prices include New Zealand Goods and Services Tax (GST) of 12.5% and already reflect a 4% discount for cash, EFTPOS, and bank cheque payments.  Payments by Credit Card will incur a non refundable 4% surcharge and normal cancellation charges will apply.
6          Tisco will not be responsible for goods lost or damaged in transit.
7          Customers are responsible for any costs incurred by unclaimed goods or refused shipments. Customers must ensure that someone is available at the delivery address to accept the goods. Tisco will use its best efforts to ensure that delivery is timely but cannot be held liable for any delayed or lost goods.

Warranty, Service and Returns Policy
8          Any goods being returned to us for warranty replacement or credit are to be labeled and consigned in accordance with our procedures. Returns for other than warranty replacement are at our discretion.
9          All goods sold in component form are warranted by the original importer, distributor or manufacturer.  All warranty claims must be forwarded to Tisco at the customers cost and be accompanied by the original invoice.
10        Unless otherwise specified, computer systems come with a one year return to base warranty.
11        Warranty only covers hardware.  It does not cover:
11.1     software installation, setup and configuration.
11.2     systems or system components no longer under warranty.
11.3     Any damage caused by virus attacks, or software related damage.
11.4     Support for Systems where the user has used the System in an abusive or negligent manner.
11.5     loss of data
12        Software cannot be returned if opened unless it is faulty.
13        "Choose carefully as we do not refund if you change your mind. If the goods are faulty we will meet our obligations under the Consumer Guarantees Act."
14        All goods returned are subject to a minimum 15% restocking fee (subject to our acceptance)
15        Goods returned must be in resalable condition with original packaging.
16        All return courier costs are covered buy the customer, unless otherwise agreed.
17        All goods delivered to or in Tisco’s possession, for repair or servicing are subject to a lien for any sums owing by the customer, for repairs or servicing carried out on the goods.  Where Tisco retains a lien over any goods and payment is more than three months overdue, Tisco may without further notice sell the goods in such a manner and such terms as it sees fit, and may from sale proceeds repay the amount outstanding, and any expenses of sale.

18        By using the Tisco website the customer accepts Tisco’s terms and conditions of trade.

Tisco does all it can to minimise the risk, however, it can not accept liability for any errors or omissions in the content of this website.

Limitation of Liability
Tisco will not be liable for lost profits, loss of business or other consequential, special, indirect, or punitive damages, even if advised of the possibility of such damages, or for any claim by any third party except as expressly provided herein. Tisco will not be liable for products or services not being available for use or for lost or corrupted data or software. The customer agrees that for any liability related to the purchase of products or services, Tisco is not liable or responsible for any amount of damages above the aggregate dollar amount paid by customer for the purchase(s) under this agreement.

Tisco reserves the right to change these terms of trade from time to time. If Tisco fails to enforce any terms or to exercise its right under these terms of trade at any time, Tisco has not waived those rights. If any provision of these terms of trade is held to be invalid or unenforceable for any reason, the remaining provisions shall remain in full force and effect ant the parties shall adjust their respective rights and obligations in accordance with the spirit and intent of the parties as shown by these terms of trade.
